Introduction

Welcome to the Physio Approved Affiliate Program! These Terms and Conditions (“Terms”) govern your participation in the affiliate program (“Program”) offered by Physio Approved (“we,” “our,” or “us”). By signing up and participating in the Program, you agree to comply with these Terms. Please read them carefully.

1. Eligibility

1.1. You must be at least 18 years old to participate in the Program.
1.2. You must provide accurate and complete registration information, including your name, email address, and payment details.
1.3. Participation is subject to approval, and we reserve the right to accept or reject any application at our sole discretion.

2. Affiliate Responsibilities

2.1. As an affiliate, you agree to promote products available on www.physioapproved.co.za in compliance with these Terms.
2.2. You will use only approved marketing materials provided by us or pre-approved by us.
2.3. You must not engage in the following activities:
• Misleading or false advertising.
• Spamming or using unsolicited email campaigns.
• Using pay-per-click ads that include our brand name without prior approval.
• Violating any applicable laws or regulations.

3. Affiliate Links and Tracking

3.1. You will receive a unique affiliate link to track referrals and sales.
3.2. Affiliates earn commissions only on purchases made through their unique affiliate link.
3.3. Cookies used for tracking referrals have a duration of 30 days. Sales made after the cookie expires will not be eligible for commissions.

4. Commissions

4.1. The commission rate is 10%, unless otherwise stated in your affiliate agreement.
4.2. Commissions are calculated on the net sales amount (excluding taxes, shipping, and discounts).
4.3. Payments will be made monthly via EFT, subject to reaching a minimum payout threshold of R500.
4.4. Commissions for returned or refunded orders will be deducted from future payments.

5. Payment Terms

5.1. Affiliates are responsible for providing accurate payment information.
5.2. Payments will be processed within 30 days after the end of the payment period.
5.3. Affiliates are responsible for any transaction fees associated with payment processing.

6. Intellectual Property

6.1. Affiliates are granted a limited, non-exclusive, and revocable license to use our trademarks, logos, and marketing materials solely for promoting our products.
6.2. Affiliates may not modify or create derivative works based on our intellectual property without written consent.
6.3. Upon termination of your participation in the Program, you must cease using all marketing materials and remove any references to our brand from your platforms.

7. Termination

7.1. Either party may terminate your participation in the Program at any time, with or without cause, by providing written notice.
7.2. Upon termination, you will no longer earn commissions, and all pending payments may be forfeited if you violate these Terms.

8. Disclaimers and Limitations of Liability

8.1. We make no guarantees regarding the performance or success of the Program.
8.2. We are not liable for indirect, incidental, or consequential damages arising from your participation in the Program.
8.3. Our total liability to you shall not exceed the total commissions earned by you during the six months preceding any claim.

9. Confidentiality

9.1. Affiliates agree not to disclose any confidential information about our business, including but not limited to sales data, marketing strategies, or customer information.

10. Modification of Terms

10.1. We reserve the right to modify these Terms at any time. Affiliates will be notified of any changes via email or through the affiliate dashboard.
10.2. Continued participation in the Program after changes constitutes acceptance of the updated Terms.

11. Governing Law

11.1. These Terms are governed by the laws of South Africa.

11.2. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
